Discovery with respect to your California Personal Injury case is a process that can and usually begins as soon as the defendant answers the lawsuit that we file on your behalf.

It is a process where each side gets to ask the other side questions, or demand documents or things that may tend to lead to admissible evidence in your personal injury case.

The defendant gets to request discovery as soon as they file their answer to the complaint.

We as the plaintiff have to wait for a period of time after the defendant answers the complaint before we get to propound discovery.

Some of the things that you might have propounded on you by the defendant are:

  • Request for a Statement of Damages;
  • Form Interrogatories;
  • Special Interrogatories;
  • Demand for Production of Documents;
  • Demand for an Independent Medical Examination;
  • Notice of Deposition; and
  • Demand for Exchange of Expert Witness Information, etc.

Discovery is by far the longest and most difficult aspect of the litigation process.

It is very important that you stay in contact with our law firm during the discovery process because for each discovery request made by the defendant to us, there is a time deadline for which we need to respond.

We will also be propounding discovery on the defendant as well.

Once discovery is completed, each side will have a very good idea about the nature and extent of all aspects of your personal injury case. That is why settlements are not usually made once a case is in litigation, until all discovery is completed.

We recommend to all our personal injury clients that you keep a journal related to your case which includes but is not limited to:

  • Dates of Medical Treatment;
  • Who was the Medical Provider?
  • What did they do for you?
  • How did you feel on that day?
  • What activities you could not do, or had difficulty doing?
  • Any out of pocket expenses, etc.
